Terms and Conditions of Sale – Ireland House Designs

Please read these Terms and Conditions carefully. By purchasing, downloading, or using our digital products, you agree to be legally bound by these terms.
1. Digital Product & Licensing Agreement
1.1 Nature of the Sale (License Grant) When you purchase a CAD or PDF drawing set from Ireland House Designs, you are purchasing a non-exclusive, non-transferable license to use the design for the construction of a single, specific house at one location only. You are not purchasing ownership of the design.
1.2 Ownership and Copyright Ireland House Designs retains all original copyright, title, and ownership of the architectural design, plans, CAD files, and PDF documents (“Instruments of Service”). These Instruments of Service are protected under the Copyright and Related Rights Act 2000 (Ireland).
1.3 Permitted Use Your license permits you to: a. Use the Instruments of Service to build one (1) single-family residence at the location specified during the planning application process. b. Make minor, non-structural modifications to the plans necessary for construction. c. Provide copies of the drawings to your builder, contractor, or local planning authority solely for the purpose of constructing that single licensed home.
1.4 Prohibited Use (Sharing & Reproduction) The license expressly prohibits the following actions: a. Sharing/Distribution: Sharing, emailing, or distributing the downloaded files (including their download link) with any third party not directly involved in the construction of the single licensed home. b. Resale/Transfer: Reselling, sub-licensing, or otherwise transferring the license or the designs to any other individual or company. c. Multiple Use: Using the designs to construct a second, separate dwelling, or using the design for any other project without purchasing an additional, separate license. d. Claim of Authorship: Claiming authorship or ownership of the original design.
Any prohibited use is a material breach of this agreement and a violation of our copyright, entitling us to seek legal damages.
2. Digital Download Access and Restrictions
2.1 Delivery Upon successful completion of payment, the customer will receive an email containing a link to download the purchased digital files (CAD and/or PDF).
2.2 Download Limits To protect our intellectual property, each purchase is subject to the following contractual limits:
- Maximum Downloads: The download link may only be accessed a maximum of three (3) times per purchase.
- Download Expiry: The download link will automatically expire seven (7) days after the date of purchase. It is the customer’s sole responsibility to download and securely back up their purchased files within these limits.
3. Refunds and Cancellation Policy (In Compliance with Irish Law)
Due to the digital nature of the products and immediate access, all sales are final and non-refundable, subject to the following legal consent:
Waiver of 14-Day Right to Cancel As per the Consumer Rights Act 2022, for contracts concerning the supply of digital content not supplied on a tangible medium:
- By checking the “I agree to the Terms and Conditions” box at checkout, the customer expressly consents to the immediate commencement of performance of the contract (i.e., immediate provision of the download link/access).
- The customer acknowledges and accepts that by giving this consent, they forfeit their right to cancel the contract and claim a refund under the 14-day cooling-off period once the download link has been accessed or the files have been successfully downloaded.
4. Disclaimers and Limitations of Liability
4.1 No Professional Services The purchase of our plans does not constitute the rendering of professional architectural services. The plans are standard construction drawings and are purchased “as-is.”
4.2 Local Codes and Engineering It is the customer’s sole responsibility to ensure that the plans comply with all local planning regulations, building codes, and structural requirements for their specific site location within Ireland. The customer must engage a qualified local engineer and/or architect to adapt the plans for site-specific conditions, soil reports, and structural calculations before construction begins.
4.3 Limitation of Liability Ireland House Designs shall not be liable for any indirect or consequential damages arising from the use or inability to use the purchased plans. Our total liability is strictly limited to the purchase price paid for the digital files.
5. Governing Law
These Terms and Conditions shall be governed by and construed in accordance with the laws of the Republic of Ireland. You agree that any legal action or proceeding arising out of or relating to these terms shall be instituted in the courts of Ireland.
